Even though 73% of the voters in District 35 are registered Democrats, incumbent Democratic State Senator Denise Harper Angel sued Independent candidate Scott Ritcher and the Kentucky Board of Elections to have his name removed from the ballot.

Her claim was based on technicalities in the process independent candidates are forced through to get on general election ballots in Kentucky. The major parties are not required to comply with these extra regulations but they are free to challenge the results submitted by others, as in this case.

During the lawsuit, she campaigned in the same neighborhood her suit asked the court to disqualify from Ritcher's nomination papers. 83% of the petitioners she sought to disenfranchise were her fellow Democrats.

Hundreds of Kentucky voters signed a petition on this website asking Denise Harper Angel to drop her lawsuit and leave a choice on the ballot. However, she did not and the court ultimately ruled in her favor. This delivered the election to her in October, without the voters having a say.

As of October 20th, Angel's campaign still had more than $33,000 in the bank, much of it collected from corruptive corporate and special-interest PACs.
